WASHINGTON — A government watchdog says the Internal Revenue Service is tormenting struggling taxpayers in the midst of a slumping economy by increasing the number of liens the agency has filed against people who owe back taxes……

The IRS rarely ever files liens. What they file is a Notice of Lien which is not a perfected lien (sometimes called inchoate liens). A perfected lien is a Notice of Lien with a court order attached. The Notice of Lien the IRS files almost never have the required court order to make them perfected “real” liens. The notice of lien is an administrative request which no one (outside of the federal government) is bound to obey, comply with, or honor.
We live in society where everyone seems to operate with fear of the IRS and not in accordance with what the law actually says. The thing that gives imperfected liens their power is ignorance of the law and compliance with criminals and liars.
